If their most worried about lawsuits in the USA then I would avoid incorporating there most likely, but the fear of a data leak from an agent is gonna be a risk in any jurisdiction unfortunately.

No, a company can only be PSC if it has its own PSC register or is a publicly listed and traded company in UK, EU/EEA, or certain other stock markets.

As a general rule, only people can be PSCs.
