Hey
I have my UAE company, I'm UAE fiscal resident (183+ days, emirates id, tax certificate residence, ejari, company, salaries from my own company)..
I have French nationality/passport, but apart from that no ties anymore with France (no company, no wife, no kids, no cars, no real estate, no bank accounts, I even returned my "Carte Vitale"). The only ties I have with France are my sisters and my mom.

BUT

Almost all my clients are from France. B2C mostly, and one French company that I make business with.

Considering that, can France requalifies me as French tax resident ? Me and/or my company ? Is it enough ?

If yes, what can I do against that ? Create another company in UK or a LLC that takes payments from the French clients, and then send it to my UAE company?
Or no, it's not enough and I'm worried for nothing?

They can do anything they want whether legal or not, but unless you snitch on yourself and give them reason to come after you, you are in the clear.

What most people fail to realize is that if France launches a case against you, you will need French accountants and lawyers (and maybe more people) to defend your rights. If your defense ends up costing you +€1M, about half of that (maybe more?) ends up in France's coffers. The providers of service pay taxes...think this through.

Although I was NOT born in mainland Europe (but instead on a colonized European island), I have relatives in 9 European countries. I have NEVER lived in Europe. Never been registered in ANY country in Europe. Notwithstanding all this, NONE of my relatives or friends in Europe (or anywhere else) know of my financial situation or tax situation. To them, I'm just a failed employee of an American company. A gofer so to speak. This minimizes the chances of anyone trying to come after me, especially if they all think I am American (I'm not) working for an American company and nobody really wants to have a d1ck-measuring contest with the USA. Also, I don't go to the USA, not even as a transit hub, but nobody needs to know this. ;)

Keep quiet and remember: There are NO mutes in prison! ;)

Enjoy life!

A ) You have done everything properly, and you don't mess anyone who has political power in France.
France is big, millions of rich people and companies, they don't have resources to investigate everyone and they just skip people who seems like completed all the required legal steps.

B ) You did the necessary steps but if you angry someone big in France they will likely find something against you, if they can't they will make something up.
Maybe you still spend months in France, paying utility or water bills, or your sister bought the house with funds originating from you, so they will claim it's actually yours.

C ) Worst you basically just moved your pre-existing company that can be a problem, if you buy cars in the EU someone eventually gets jealous of you and report you and they will investigate you.

I heard about people in the EU who believed a residency paper and making a new company in the UAE is enough (some even kept the same company name or notified the clients of the company change).
They freezed their bank accounts and houses very quickly, after they could choose between paying back 2-3x of the corporation tax they saved or a few years of prison.

Reading your text it looks like you belong to the A category so you should be okay, don't worry too much, you even returned your insurance card, nobody will care about you just don't flaunt your money in France or on Social Media.

True words of wisdom!
Parents should teach their children this BEFORE they even attend kindergarten! ;)

Hello guys, thanks for the answers.
One question :
I closed my French company at the beginning of 2023 (january), aswell as my bank accounts.

Those are the only ties I had with France during this year. Can you confirm that just because of this, they won't label me as a French tax resident for 2023? "You had business and bank accounts in France in 2023, so you are French tax resident in 2023" ?

Thanks!

You need professional advice about that.
In many country merely having bank account is not enough to be tax resident.
If you lived in 2023 and had business this could be an issue. But normally only for month of January you should be tax resident.
But it's different country by country

Most customers never mind what company they pay for or where that company is registered
